Highlights
International Criminal Court (ICC) should clarify if they choose not to confirm receiving the Claim and letters or if they did not receive them. Besides, ICC should clarify if the court used to send a response to a claim via email and not via post, as well as if ICC used not to confirm claims and letters that the court received.
On 29 January 2020, a claim was given to ICC about Crimes Against Humanity against Dr. Ziva Rozen-Bakher and Daniel Bakher, as well as about Cover-up crimes and Obstruction of Justice related to the Crimes Against Humanity. ICC only once time confirmed that they received an email from Dr. Ziva Rozen-Bakher when she sent them for the first time the copy of complaint II to Portuguese Police as preliminary information to the claim. The claim was given two weeks later via email, fax and post. However, ICC NEVER confirm that they received the claim via email, fax and post, despite repeated requests from Dr. Rozen-Bakher that ICC will confirm receiving the claim. ICC even did not confirm any additional information and proofs provided via emails, faxes and posts following the Claim. Eventually, a few months later, ICC sent its decision letter by email and not via post, still, based on the decision letter it’s unclear if the decision was made based on the claim or based on complaint II to Portuguese Police because the mention in the letter decision raises doubt if ICC got the full version of the claim.
There are hard proofs about blocking emails and Faxes that were sent to ICC. For example, three types of fax errors - 363, 350, and 340 - were provided regarding the blocking faxes from England to ICC via the landline of EE, still, on 14 February 2020, the blocking faxes occurred the same as in the previous attempts, but when Dr. Rozen-Bakher turn-off the internet router of EE, then the Fax was sent, which proves that the blocking-cyber was made via the internet of EE. Importantly, during this period in England, other Faxes were sent successfully even around the same time when Faxes were blocked to ICC.
Even an Urgent Letter to Mr Karim Khan, the Prosecutor of ICC that was sent a year later via email to ICC was blocked via the mailbox of Ziggo in Netherlands. Eventually, the email was sent via Mailfence mailbox, yet without any confirmation or response from ICC. Importantly, an envelope with this letter was put by Dr. Rozen-Bakher and her son in the ICC Post-Box that locates at the Entry of ICC building. In spite of that, Dr. Rozen-Bakher NEVER got any response from ICC to this urgent letter. Note, ICC in his decision letter following the claim argued that if additional crimes will be conducted, then it will be possible to give additional proofs. In spite of that, ICC even did not confirm or respond to the urgent letter that was sent a year and a half after the claim.
