It is very sad for me to write this comment because the USA in the past was a symbol of Democracy, Freedom, and Justice, and now, to see how the USA Senate makes Obstruction of Justice by threatening the International Criminal Court (ICC) with sanctions, with the aim of trying to influence the court regarding its work in general, and in particular, regarding issuing arrest warrants against Israeli leaders. To clarify, in my comment here, I am not dealing with whether the ICC should or should not issue arrest warrants against Israeli leaders, but in the act of the Obstruction of Justice by the USA Senate, namely any court should operate without threats by political actors, especially by Senators. If we look at the letter of the USA Senate to ICC (see below), then the USA Senate started to act as a ‘USA Senate International Court’ by saying to ICC to whom ICC should issue arrest warrants and to whom not. Let’s say that politicians and the public in general have the right to say their opinions regarding the work of ICC, but definitely, no one has the right to Obstruct the Justice via threats against ICC in general, and in particular, by threatening with sanctions. I would like to remind the USA Senate that everyone has the right to give Claims to ICC if they believe that someone committed War Crimes, Crimes against Humanity, Genocide and such, so if the USA Senate believes that Iran, Hamas, and others committed  War Crimes, Crimes against Humanity, Genocide and such, then the USA Senate can hire lawyers that will give Claims to the ICC. However, the USA Senate can not do it formally under the ‘USA’, because the USA did not ratify the Rome Statute that the ICC operates upon it, so the USA has no say in ICC, regardless that no one can give a Claim against the USA in the ICC. The USA should denounce this Obstruction of Justice against the ICC by the USA Senate, and importantly, the USA Senate should decide if it would like to act as a ‘USA Senate International Court’ or as a legislative body that is responsible for passing or defeating federal legislation. Otherwise, we have the risk of anarchy at the global level if the International Justice System operates under Obstruction of Justice by State Actors.
